Passport Program Terms & Conditions

1. Overview

The Passport Program (the “Program”) is a customer loyalty initiative offered by The Middle Spoon. By participating in the Program, you agree to these Terms & Conditions.

The Program allows participants to collect eligible drinks, track progress, and earn rewards based on participation.

2. Eligibility

• Participants must meet the legal drinking age in Nova Scotia.
• Participation is limited to individual persons only.
• One account per person is permitted.
• Accounts may not be shared, transferred, or duplicated.

The Company reserves the right to suspend or terminate duplicate or shared accounts.

3. Responsible Service & Conduct

The Middle Spoon is committed to responsible alcohol service.

• We do not condone, endorse, or allow overservice.
• Participation in the Program does not guarantee service.
• We reserve the absolute right to refuse service to any guest at any time, for any reason, including concerns related to intoxication, safety, or conduct.

4. Drink Codes & Redemption

• Eligible drinks may include a unique code (the “Drink Code”).
• Drink Codes must be entered into the Program within 5 days of purchase.
• The Company reserves the right to invalidate or remove any Drink Code entered after this period, even if initially accepted by the system.

Drink Codes:

• Have no cash value
• Are non-transferable
• May only be used by the original purchaser

5. Proof of Purchase

• Participants are required to retain receipts for eligible purchases.
• The Company may request proof of purchase at any time.

Failure to provide valid proof may result in:

• Removal of drinks from your Passport
• Denial of rewards
• Account suspension or termination

6. Misuse, Abuse & Fraud

To maintain fairness and integrity, the following are strictly prohibited:

• Sharing, distributing, or selling Drink Codes
• Entering codes without a legitimate purchase
• Attempting to manipulate, exploit, or reverse-engineer the system
• Creating multiple accounts or using another person's account

If misuse is suspected, the Company reserves the right to:

• Remove drinks or entries
• Deny or revoke rewards
• Suspend or permanently terminate accounts
• Refuse future participation

All determinations made by the Company are final and binding.

7. Rewards

• Rewards are earned based on Program milestones.

Rewards:

• Are non-transferable
• Have no cash value
• Cannot be exchanged, refunded, or redeemed for cash
• May have expiration dates

The Company reserves the right to:

• Modify or substitute rewards at any time
• Limit redemption quantities
• Deny redemption if Terms & Conditions are violated

8. Chargebacks & Disputes

If a purchase associated with a Drink Code is refunded, charged back, or disputed, the Company reserves the right to:

• Remove the associated drink from your Passport
• Revoke any rewards earned from that purchase
• Suspend or terminate your account

9. Program Changes & Termination

The Company may, at its sole discretion:

• Modify, suspend, or terminate the Program at any time
• Change rules, eligibility, rewards, or structure without notice

10. Limitation of Liability

The Company is not responsible for:

• Technical errors, delays, or system failures
• Lost, delayed, or invalid Drink Codes
• Unauthorized account access
• Any indirect or consequential damages arising from participation

Participation in the Program is at your own risk.

11. Governing Law

These Terms are governed by the laws of Nova Scotia, Canada.
